Title: Senior ERISA Attorney



  • Location: United States

Essential Duties and Responsibilities:



  • Consultant Level

    • Job responsibilities of Senior ERISA Consultant



  • Training

    • Conduct presentations at professional conferences (e.g., MN CLE, CPE conferences, CFP)



  • Course Development

    • Design, write, and update internal or external training modules on ancillary laws



  • Legal Retirement Plan Document Drafting

    • Review and consult with clients on requests to customized provisions in Ascensus retirement plan documents (e.g., beneficiary designation options, minor modifications, IRS model form changes)



  • Fee-for-Service Engagements (Corrections, Controlled Group Determinations, Determination Letter Filings)

    • Independently perform custom advanced external fee for service consultations (e.g., nonbank trustee applications, group submissions, VFCP)



  • Disputes, Policies, Inquiries and Subpoenas

    • Draft formal responses to legal or other inquiries to attorneys, the IRS, DOL or other governmental agency

    • Discuss complex legal or other issues with attorneys, the IRS, DOL or other governmental agency

    • Draft template and customized correspondence and legal memorandum



  • Expansion of Services

    • Independently perform review and approval of QDROs and other advanced benefit claims processing (e.g., hardship distributions)

    • Independently perform QDRO consultations and other advanced benefit claims processing (e.g., hardship distributions)



  • Death Claim Review

    • Independently perform review and approval of death claims

    • Independently perform death claim consultations



  • Legal Research

    • Complete advanced legal research projects and present advanced legal research findings

    • Mentor associates to conduct retirement plan and legal research



  • Technical Writing

    • Write comprehensive findings and recommendations of advanced legal research projects (e.g., white paper)



  • Retirement Technical Knowledge (QRP and specialty plans (e.g., 403(b), 457, DB, Cash Balance, ESOP, non-qualified, 409A))

    • Demonstrate a functional knowledge of ESOP, non-qualified plans and 409A plans



  • Industry Knowledge

    • Demonstrate functional knowledge of retirement income planning strategies

    • Demonstrate knowledge of retirement industry trends, forecasts and developments



  • Industry Participation

    • Participate on professional, regulatory, industry or policy-making boards, committees, or subcommittees



  • Ancillary Laws

    • Analyze and interpret significant legislative, statutory, regulatory or case law guidance of certain ancillary laws (e.g., securities, estate planning, banking, social security, Medicare, bankruptcy, e-sign)

    • Analyze and interpret significant legislative, statutory, regulatory, or case law guidance on various business structures (e.g., sole proprietor, partnerships, corporations, LLC, non-profit, stock attribution, foreign affiliates)

    • Demonstrate basic knowledge of state laws that apply to retirement plans (e.g., withholding, domestic relations, debtor/creditor, preemption)



  • Continuing Education

    • Obtain continuing education credits to maintain licensure in at least one jurisdiction



  • Corporate Legal

    • Work with corporate legal counsel to review and draft agreements and perform other corporate legal work as necessary (e.g., copyright, trademark)



  • Mentoring

    • Successfully mentor ERISA Attorney




Minimum Requirements:



  • Degrees

    • JD from an accredited law school. Maintain an active license in at least one jurisdiction



  • Industry Experience

    • 7 years of Ascensus experience or 10 years industry experience



  • Performance Review Ratings

    • Performance review ratings of exceeding expectations



  • Core Values & I-Client

    • Consistently display and model the Ascensus core values and I-Client philosophy



  • Prior Consultant Level Completion

    • Successfully demonstrate job responsibilities of ERISA Consultant (Level 2)



  • Prior Attorney Level Completion

    • Successfully demonstrate job responsibilities of ERISA Attorney
